Toyota, Putting Profits Over Safety

Most Americans are aware of Toyota Motor Corporation, recalling 4 million vehicles with unresponsive and, in some cases, stuck gas pedals. Toyota is estimating a loss $2.7 billion in 2010. U.S. dealers say they spend more time answering calls from existing Toyota customers than enticing new customers to buy vehicles not equipped with the faulty part and that is impacting new sales.

During an internal Toyota (TM) government relation meeting in July 2009, Yoshimi Inaba, chief of Toyota’s North American operations, presented a document that stated. “Saved 100M+, w/no defect found,” the document states under a section labeled “Wins For Toyota—Safety Group.” Toyota saved more than $100 million by negotiating an agreement with U.S. safety regulators that led to a limited “equipment” recall of Camry and Lexus ES350 vehicles.

Toyota first blamed incidents on floor mats, instead of a potentially more costly defect with the car itself. In August 2009, the month following the presentation in which the Inaba boasted of saving $100 million over a full recall, a family of four was killed in a Lexus with its gas pedal stuck under a floor mat. Toyota vehicles are known for safety and value; however this “smoking gun” document, portrays Toyota as putting profits over safety.

Corolla Recall Steering Problems – Toyota is considering a recall of its top-selling Corolla subcompact after complaints about power steering problems. This is another blow to the world’s largest automaker, already dealing with a string of recalls and multiple civil suits in U.S. courts. Despite pressure from lawmakers, Toyota has a U.S. congressional hearing, on their quality lapses. President Akio Toyoda said, “I trust that our officials in the U.S. will amply answer the questions, we are sending the best people to the hearing, and I hope to back up the efforts from headquarters.” The Company also denied any cover-up as the U.S. investigates whether it was enough in recalling millions of Toyota cars over the problems affecting other car models. Toyota said there are currently less than 100 potential complaints with the Corolla Recall in the US.

Toyota announced a voluntary safety recall of about 8,000 four-wheel-drive 2010 Tacoma trucks in North America. Sources are speculating that certain vehicles from Ford Motor Co. and Nissan Motor Co. may also be involved in this recall. Toyota states the front shaft in a small production run of pickups may include a component that developed cracks during the manufacturing process. The automaker said Friday, as the vehicles are used, the cracks could lead to the separation of the drive shaft at the joint portion. Driving your Tacoma under these conditions may lead to serious injuries or fatalities due to the potential loss of control while driving your Tacoma. Toyota will offer the safety inspection and replacement at no cost.

If you didn’t catch the hidden safety recall for the 7,300, 2010 Toyota Camry, within the press release about the Toyota Prius recall. M&A law firm has provided an excerpt from the press release is as follows:

Separately, Toyota will conduct a voluntary safety recall on approximately 7,300 early production – 2010 model year Camry vehicles equipped with the 4 cylinder engine to inspect for a power steering hose that may be in contact with a front brake tube. This contact could lead to a hole in the brake tube and cause a brake fluid leak, increased brake pedal stroke and greater vehicle stopping distance. Owners of the involved 2010 Camry vehicles will be notified by mail starting in the middle of February.

The issues is on certain early production 2010 model year Camry vehicles equipped with the 4-cylinder engine, a power steering pressure hose in the engine compartment may be the incorrect length. If this condition exists, a crimp on the power steering pressure hose may come in contact with the No. 7 front brake tube. If this condition is not fixed, a hole may wear in the brake tube and deplete the brake fluid in the vehicle? As a result, the brake pedal stroke will increase and lead to greater vehicle stopping distance which may lead to hazardous and even fatal driving conditions. Toyota will notify owners by mail starting in mid-February 2010.

If you have been injured while riding in a Toyota on the recall list, or been in an accident in a 2010 Toyota Camry due to greater vehicle stopping distance, please contact M&A Law Firm toll-free at 1-866-789-1664, and speak with a products liability attorney concerning your Toyota’s safety. Toyota has recalled around 8.5 million vehicles and now faces a growing number of consumer class-action cases, over the shrinking resale value of its recalled models. The consumer class actions are based on the premise that for Toyota car buyers “if you went to sell your car today, it’s worth a lot less than it was two weeks ago.” Consumer lawsuits seeking economic damages for diminished value or lost use of a recalled Toyota vehicle have been filed in at least 30 states, mostly in federal court. All the federal suits would be consolidated into a single class action in the next three to four months, following a hearing before a panel of judges set for March 25 in U.S. District Court in San Diego. Toyota has maintained one of the industry’s highest resale values for its vehicles, as well as a superb record of reliability and safety. Major vehicle valuation services like Edmonds and Kelley Blue Book have downgraded the resale value of Toyotas by as much as 3.5 percent, and further decreases up to 6 percent can be expected.

Toyota Motor Sales, U.S.A., Inc, announced a voluntary safety recall on approximately 133,000 2010 Model Year Prius vehicles and 14,500 Lexus 2010 HS 250h vehicles to update software in the vehicle’s anti-lock brake system (ABS). This recall does not include Toyota, Lexus, or Scion vehicles. The ABS system prevents wheel lock-up by automatically modulating the brake pressure during an emergency stop. By preventing the wheels from locking, it enables the driver to maintain steering control and to stop in the shortest possible distance under most conditions. Some 2010 model year Prius and 2010 HS 250h owners have reported experiencing inconsistent brake feel during slow and steady application of brakes on rough or slick road surfaces when the ABS is activated in an effort to maintain tire traction. This faulty software can potentially lead to serious injuries or fatalities, due to the loss of braking control in the 2010 Prius and 2010 Lexus HS 250h Vehicles.

If you have been in an accident in a 2010 Prius or a 2010 Lexus HS 250h, please contact M&A Law Firm toll-free at 1-866-789-1664, and speak with a products liability attorney concerning your Toyota’s safety. You can also click here to fill out our convenient online case evaluation form.

Honda has now recalled 440,000 of its popular vehicles because of potential problems with the vehicles’ airbags that can cause injury or death to motorists. The defect reportedly involves the drivers-side airbags. The affected Honda vehicles include some 2001 and 2002 Accords, Civics, Odysseys, and CR-V models, as well as the 2002 Acura TL models. One Honda Pilot and one Acura CL vehicle (yes, one vehicle for each model), produced in late 2002, are also included. The problem stems from the vehicles’ airbag inflators, which can place too great a force on the airbag when put into use, fracturing the inflator and causing metal shards that have resulted in 12 incidents, including one fatality.

Defective car parts, including airbags, are a leading cause of injury and death in the United States. U.S. dealers say they spend more time answering calls from existing Toyota customers than enticing new customers to buy vehicles not equipped with the faulty part and that is impacting new sales.

Toyota states on their website, “Toyota has taken the unprecedented step of stopping production to help serve our customers quickly and ensure that all new Toyota vehicles going forward do not experience this problem.” Brian Johnson, an automotive analyst at Barclays Capital, expects Toyota to see its market share decline each week the shut-down is in effect.

While the company is focusing all of their energy and resources on remedies to fix the issue, they also face a pending class-action lawsuit, after 19 deaths have been related to the faulty accelerator pedal. The most recent accident in Southlake, Texas – killed four Jehovah Witness’ riding together to promote their faith. Southlake, investigators say, the vehicle crashed through a fence and hit a tree before landing upside down in a pond.
